Terms & Conditions

These Terms and Conditions govern your relationship with Mez Lighting and apply to all orders, deliveries, and services. By placing an order or engaging with our services, you acknowledge that you have read, understood, and agree to be bound by these terms.

1.
Agreement
  • By ordering, paying for, or accepting delivery of any Mesmerize Lighting product (“Products”), you agree to these Terms & Conditions, even if no signed agreement exists.
  • Mesmerize Lighting (“we”, “us”, or “our”) may update these terms at any time, and notice will be sent via newsletter or email.
2.
Accounts & Applications
  • All customers (“you” or “the Client”) must have an approved trading account to purchase from us.
  • PSO (Payment Secures Order): Orders are paid in full before dispatch.
  • Credit Account: Purchases may be made on approved credit terms.
  • We may require a Personal Suretyship or Credit Liability Undertaking for accounts exceeding R50,000.
  • Approval of accounts is at our discretion, based on financial and business verification.
3.
Orders & Quotations
  • Orders must include an official Purchase Order Number (P.O.).
    • No handwritten or verbal orders will be accepted.
    • Quotations are valid for 7 days, subject to stock availability.
  • An official Tax Invoice will be issued upon receipt of a valid P.O. Mez Lighting reserves 2 business days to finalize order details before shipping.
4.
Payment Terms
  • PSO Accounts: Full payment required before dispatch.
  • Credit Accounts: Payment due within 30 days of invoice month-end, unless otherwise agreed.
  • Project Orders: Require a 35% deposit to begin production.
  • Orders over R300,000 may not be cancelled once placed.
  • Late payments may incur interest and legal costs at the maximum rate allowed by law.
5.
Delivery
  • Orders are delivered via our official couriers or can be collected from:
    • Durban: Unit F3, Tradepark, 54 Siphosethu Rd, Mount Edgecombe
    • Port Elizabeth: Unit 26–28, Federated Park, 26 Paterson Rd, North End
  • Free delivery for orders over R6,000 (excl. VAT); otherwise R350 delivery fee applies.
  • Standard timeframes (subject to stock & courier schedules):
    • Local: within 24 hours
    • National: 24–48 hours
    • Outlying areas: 48–72 hours
  • If delivery is missed due to incorrect details or unavailability, redelivery costs apply.
  • Risk passes to you once goods are collected or delivered.
6.
Inspection & Claims
  • Check your delivery immediately. Report any damage, shortages, or errors in writing within 24 hours (with photos).
  • If no claim is received within 24 hours, goods are deemed correct and complete. Valid claims may result in replacement, redelivery, or a credit note — at our discretion.
7.
Returns Policy
  • We accept returns if goods were defective, incorrect, or not as per agreed specification.
  • To request a return:
    • Notify us in writing within 10 business days.
    • Include proof of purchase, details, and photos.
    • Goods must be unused and in original packaging.
  • If the return is not due to our error:
    • Return shipping is at your cost.
    • Up to 15% handling fee may apply.
    • Custom-cut or special-order goods are non-returnable. (e.g. striplight)
8.
Warranty
  • Each product carries a manufacturer’s warranty as stated on its packaging or in our catalogues.
  • Warranties are valid only if installed by a qualified electrician, used within rated limits, and not modified.
  • Warranty claims follow an off-site process:
    • return the product for inspection.
    • Installation or removal costs are not covered.
  • The full warranty document is available upon request.
9.
Project Orders
  • Project or made-to-order products require a non-refundable 35% deposit.
  • Once production starts, orders cannot be cancelled.
  • Lead times are estimates only
    • Delays do not entitle cancellation or claims.
    • Our liability is limited to repair, replacement, or refund of defective items.
10.
Loss, Risk & Ownership
  • Ownership remains with Mesmerize Lighting until full payment is received.
  • Risk of loss or theft passes upon delivery or collection.
  • Clients must store goods safely and report theft or loss immediately.
11.
Legal Compliance
  • We comply with the Consumer Protection Act (CPA), POPIA, and PAIA.
  • Personal data is collected only to process orders, manage accounts, and meet legal requirements.
  • Data is securely stored and may be accessed only by authorized personnel.

12.
Anti-Bribery & Ethics
  • We have zero tolerance for bribery, fraud, or unethical conduct.
  • Any breach may lead to immediate termination of business and reporting to authorities.
13.
Confidentiality
  • All pricing, designs, communications, and product details shared between Mesmerize Lighting and the Client are confidential and may not be shared with competitors or third parties.
14.
Governing Law
  • This Agreement and all transactions between Mesmerize Lighting and the Client shall be governed by and interpreted in accordance with the laws of the Republic of South Africa, including but not limited to:
    • The Consumer Protection Act, 68 of 2008 (CPA) – governs consumer rights and product quality standards.
    • The National Credit Act, 34 of 2005 (NCA) – governs credit terms and account facilities.
    • The Companies Act, 71 of 2008 – governs business operations and legal standing of entities.
    • The Electronic Communications and Transactions Act, 25 of 2002 (ECTA) – governs electronic orders, communications, and online transactions.
    • The Protection of Personal Information Act, 4 of 2013 (POPIA) – governs how personal and business data is collected, stored, and processed.
    • The Arbitration Act, 42 of 1965 – governs arbitration procedures for resolving disputes.
    • The Prescription Act, 68 of 1969 – governs time limits for enforcing contractual claims.
    • The Prevention and Combating of Corrupt Activities Act, 12 of 2004 – governs anti-bribery and corruption conduct.
15.
Updates
  • We may amend these Terms & Conditions from time to time.
  • Continued trading with Mesmerize Lighting implies acceptance of any updated terms.
